Terms of Use

1. Introduction

These Terms of Use ("Terms") govern your access to and use of The Purple Sector website and services at thepurplesector.com (the "Service"), operated by The Purple Sector LLC, located at 11447 NW 34th Str, Doral, FL, 33178. By using the Service, you agree to these Terms and our Privacy Policy.

If you do not agree, do not use the Service.

2. Eligibility

You must be at least 16 years old to use the Service. The Service is not intended for, and we do not knowingly collect personal information from, children under the age of 13. By using the Service, you represent and warrant that you meet these age requirements.

You are responsible for complying with all applicable laws in your jurisdiction, including laws related to motorsport participation, sim racing, and online conduct.

3. Service Description

The Purple Sector provides a motorsport coaching platform that may include, among other features:

  • Sim coaching and live (track) coaching sessions between students and coaches.
  • Video analysis and coach-recorded video feedback.
  • Community boards, direct messaging, and member profiles.
  • Membership subscriptions and coach marketplace bookings.
  • Sim setup marketplace and related member resources.

We may add, modify, or discontinue features at any time. We will use reasonable efforts to notify users of material changes that affect paid services.

4. Coaching Disclaimer

Coaching, video reviews, and community content on the Service are provided for educational and informational purposes only. They do not constitute professional driving instruction, engineering advice, medical advice, or a guarantee of performance, safety, or results on track or in competition.

Motorsport and high-performance driving involve inherent risks, including serious injury or death. You assume all risks associated with on-track activity, vehicle operation, mechanical setup, and competition. The Purple Sector LLC is not responsible for track incidents, mechanical failures, vehicle damage, injuries, penalties, or losses arising from your use of coaching content or participation in motorsport activities.

Coaches on the platform are independent providers. We do not employ coaches and do not guarantee the accuracy, completeness, or suitability of any coach's advice for your specific situation.

5. Accounts and Membership

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately if you suspect unauthorized access.

Coach accounts require application and approval. Coaches who receive payouts must complete Stripe Connect onboarding and comply with Stripe's terms and identity verification requirements.

Membership tiers, session limits, and feature access are described on the Service and may change with notice where required.

6. Payments and Refunds

Payments for memberships, coaching sessions, and video reviews are processed by Stripe via hosted Checkout or Stripe Connect. We do not store full payment card numbers on our servers. By making a purchase, you also agree to Stripe's applicable terms and policies.

Pricing

Coach-set prices must meet platform minimums. As of the last updated date above:

  • Track/live coaching sessions: minimum $1 USD per session (plus applicable platform fees).
  • Video reviews: minimum $1 USD per review (plus applicable platform fees).
  • On-Demand video review premium: an additional $0 USD when selected at checkout.
  • Sim coaching sessions: minimum $1 USD per session (plus applicable platform fees).

Final prices, platform fees, and taxes (if applicable) are shown at checkout before you complete payment.

Subscription cancellation

You may cancel your active membership subscription at any time from the Payment page in your account. Cancellation schedules your subscription to end at the close of your current billing period. You keep membership access and benefits until that date. Voluntary cancellations do not qualify for pro-rated or partial refunds for unused time in the current billing period. You may resume a scheduled cancellation before the period ends from the same page.

Refunds

If a coach cancels a paid video review or declines an on-demand review request, we issue a full refund to your original payment method through Stripe where technically feasible.

Other refund requests (for example, completed sessions, membership charges, or disputes about coaching quality) are evaluated case by case. Contact michael@thepurplesector.com with your booking or payment reference. Refund eligibility may also be subject to Stripe's policies and applicable consumer protection laws in your jurisdiction.

7. User Content and Community Conduct

You may post content in community boards, messaging, profiles, and coaching workflows ("User Content"). You retain ownership of your User Content, but grant us a non-exclusive, worldwide license to host, display, reproduce, and distribute it as needed to operate the Service.

You agree not to post or share content that:

  • Is harassing, threatening, hateful, or discriminatory.
  • Is spam, misleading, or impersonates another person or entity.
  • Is illegal, infringes intellectual property, or violates others' privacy.
  • Contains malware or attempts to disrupt the Service.

Community boards and messaging are actively moderated by administrators. Report violations to michael@thepurplesector.com. We may remove content, restrict features, or suspend accounts that violate these Terms.

8. Intellectual Property

The Service, including its design, branding, software, and original content (excluding User Content), is owned by The Purple Sector LLC or its licensors and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service except as expressly permitted.

9. Third-Party Services

The Service integrates with third-party providers including Stripe (payments), Zoom (meeting scheduling for coaches who connect Zoom), Cloudflare (video storage and delivery), Vercel (hosting), Supabase (authentication and data), and optional sign-in providers such as Google and Discord.

Your use of third-party services is subject to their terms and privacy policies. See our Privacy Policy for details on how we share data with sub-processors.

10. Termination

Closing your account

To close your account, email michael@thepurplesector.com with the subject line "Account Deletion Request" from the email address associated with your account. We will verify your identity and process the request within a reasonable timeframe, subject to legal and operational retention requirements described in our Privacy Policy.

Suspension and bans

We may suspend or terminate your access immediately if you violate these Terms, engage in fraud or abuse, or if required by law. Administrators may ban accounts for repeated or severe violations. Banned users lose access to protected areas of the Service.

Effect of termination

Upon termination, your right to use the Service ends. Provisions that by their nature should survive (including payment obligations, disclaimers, and limitation of liability) will survive. Data handling after account closure is described in our Privacy Policy.

11. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PURPLE SECTOR LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).

Some jurisdictions do not allow certain limitations of liability; in those jurisdictions, our liability is limited to the fullest extent permitted by law.

12. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles. You agree that exclusive jurisdiction for disputes arising from these Terms or the Service lies in the state or federal courts located in Miami-Dade County, Florida, and you consent to personal jurisdiction in those courts.

If you are a consumer in Canada or another jurisdiction with mandatory consumer protection laws, nothing in these Terms limits rights that cannot be waived under applicable law.

13. Changes and Contact

We may update these Terms from time to time. We will post the revised Terms on this page and update the "Last updated" date. Material changes may be communicated by email or in-app notice where appropriate. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
